“nCase” or “nTH Ventures” or “nthVentures.com” (“we,” “us” or “our”) respects the privacy of our users (“user” or “you”). This Privacy Policy explains how we collect, use, disclose, and safeguard your information when you visit our application (the “Application”). IF YOU DO NOT AGREE WITH THE TERMS OF THIS PRIVACY POLICY, PLEASE DO NOT ACCESS THE APPLICATION. We reserve the right to make changes to this Privacy Policy at any time and for any reason. Changes are effective as of the updated date shown above. Continued use of the Application constitutes acceptance of the revised policy. This Privacy Policy does not apply to third-party online/mobile stores or payment processors. We are not responsible for third-party data practices. DATA PRIVACY COMPLIANCE We collect and process information in compliance with the Data Privacy Act of 2012 (Republic Act No. 10173), the Cybercrime Prevention Act of 2012, and their respective implementing rules and regulations. We are committed to protecting the confidentiality, integrity, and availability of personal data entrusted to us and ensure that collection, use, and storage are conducted in accordance with Philippine data privacy standards. COLLECTION OF YOUR INFORMATION PERSONAL DATA Includes identifiable information such as your name, email address, and any other details voluntarily provided. This may occur via consent forms, chats, comments, surveys, and other interactions within the Application. Information you share in public areas of the Application is accessible to anyone who uses the Application. GEO-LOCATION INFORMATION We may request location access to provide services. You can manage this in your device’s settings. DEVICE ACCESS Access to your camera may be required for identity verification. Without this, you may not be allowed to use the application. EMAIL ACCOUNT INTEGRATION (YAHOO MAIL) nCase allows users to optionally connect their Yahoo Mail account to send outbound email messages from their own email address within the nCase platform. Scope of Access. nCase’s access is limited to sending outbound messages explicitly composed and initiated by the user within the App. nCase does not read inbox messages, access historical emails, scan/analyze mailbox content, or access contacts, calendars, or address books. Authentication. Yahoo Mail is connected via OAuth authentication. nCase does not store Yahoo passwords. Access may be revoked at any time through Yahoo account settings and/or within the App. Processing and Storage. Email content (including recipients, subject, body, and attachments selected by the user) is processed only as necessary to transmit the message to Yahoo’s mail servers for delivery. nCase does not use email content for advertising, marketing, profiling, analytics, or machine learning. nCase may retain limited delivery logs (e.g., date/time sent and delivery status) for security, reliability, and support purposes, and retains such logs only as necessary under its retention practices. Sharing. Email content is transmitted to Yahoo for delivery. nCase does not sell or rent Yahoo Mail data and does not share it with third parties except as necessary to provide the Email Integration (including Yahoo for delivery and contracted service providers bound by confidentiality and security obligations). PUSH NOTIFICATIONS We may request to send push notifications. You can opt out via your device settings. CASE DATA AND SENSITIVE INFORMATION Because nCase is designed for legal professionals, you may upload or input sensitive case information, schedules, and related records (“Case Data”). All Case Data you enter remains your property. By using the Application, you grant us a limited, non-exclusive, royalty-free license to store, process, and transmit this data solely to provide and improve the Application’s functionality. We do not access, review, or use your Case Data except as necessary for system operation and maintenance. You are solely responsible for ensuring that any Case Data you upload does not violate confidentiality obligations or third-party rights. You (nCase Users) are responsible for ensuring you have lawful authority and client consent, where required, to transmit Case Data through email, and that doing so complies with your confidentiality and professional obligations. DISCLOSURE AND USE OF YOUR INFORMATION Your information will not be shared without your consent, legal obligation, or prior notice. We are not responsible for third parties you interact with independently. Use of your data includes but is not limited to: • Account and profile management • Targeted messaging (with your consent) • Emergency response and calamities • Fraud monitoring and prevention • Statistical analysis and analytics • Notifications and updates • Customer support and dispute resolution • Soliciting feedback • Improving application performance and user experience • Support to law enforcement or LGUs • Marketing and communications (with consent) • Third-party services (SMS, email, hosting, ads, analytics) • Sharing with affiliates and financial partners (with policy adherence) • Offer walls and third-party advertising • Sale, merger, or reorganization scenarios DATA SHARING WITH THIRD PARTIES Where we engage third-party service providers (e.g., cloud hosting providers such as Google, analytics services, or messaging platforms), such sharing is strictly limited to what is necessary to provide and improve the Application. These third parties are bound by contractual obligations to maintain the confidentiality and security of your data and to process it only in accordance with our instructions and this Privacy Policy. If you enable Email Account Integration (e.g., Yahoo Mail), emails and attachments you send through the App are transmitted to your email provider for delivery. See “Email Account Integration (Yahoo Mail)” for details on scope, processing, and retention. TRACKING TECHNOLOGIES We use cookies, web beacons, and third-party analytics to enhance the experience. You may opt out via browser or device settings, although doing so may affect certain functionalities. THIRD-PARTY WEBSITES Links to third-party websites are not covered by this policy. You are encouraged to review their privacy terms independently. SECURITY OF YOUR INFORMATION While we apply appropriate physical, organizational, and technical security measures, no system is fully secure. Data may be stored on secure third-party cloud infrastructure such as but not limited to Google. You acknowledge that all online interactions carry some inherent risk, and you agree to use the Application with that understanding. DATA RETENTION POLICY We retain your personal data and case information only for as long as necessary to fulfill the purposes described in this Privacy Policy, comply with legal obligations, resolve disputes, and enforce agreements. If you delete your account or request deletion, we will remove or anonymize your data within a reasonable period, subject to legal or regulatory retention requirements. TRANSFER OF DATA If you access the Application from outside the Philippines, you acknowledge and agree that your data will be transferred to, processed, and stored in the Philippines, where data protection laws may differ. By continuing to use the Application, you consent to such transfer and processing. We may require verification of your identity before acting on your request. Some requests may be subject to limitations under applicable law. WAIVER OF LIABILITY FOR USER-PROVIDED DATA You acknowledge that you are solely responsible for the accuracy, legality, and confidentiality of any personal or case-related data you input into the Application. nTH Ventures shall not be liable for any consequences, damages, or losses resulting from inaccurate, incomplete, or improperly disclosed information provided by you.
